Answer Book question

Can I get a free lawyer in Kerala?

Yes, through the Kerala State Legal Services Authority and its district and taluk committees. Free legal aid, including a lawyer, court fees and documents, is available to women and children regardless of income, to members of Scheduled Castes and Tribes, persons with disabilities, victims of trafficking, disasters or violence, industrial workmen, persons in custody, and to anyone whose annual income is below the state's ceiling (Kerala's has been ₹3 lakh; confirm the current figure). The Authority also runs Lok Adalats, where bank loan settlements, accident claims, cheque cases and family disputes are settled by agreement at no cost, and para-legal volunteers at the panchayat level who will help you fill the form.

Real life

A widow in Ranni with a pending motor accident claim and no money for a lawyer walks into the Taluk Legal Services Committee at the Munsiff court. She is eligible as a woman regardless of income. A panel lawyer is assigned, the court fee is borne by the Authority, and the Tribunal claim proceeds.

What this means

The Legal Services Authorities Act, 1987 created NALSA, state authorities (KeLSA in Kerala), District Legal Services Authorities at every district court and Taluk Legal Services Committees at taluk courts. Section 12 lists the categories entitled to aid irrespective of income; the income ceiling for everyone else is set by the state (and ₹5 lakh for the Supreme Court).

Services: advice, drafting, representation by a panel advocate, payment of court fees and process fees, certified copies, and appeals. Applications are a simple form with an income declaration or category proof; the front office decides within days. Lok Adalats, held regularly and in special national drives, settle matters by compromise; the award is final, binding and has the force of a decree, with no appeal, and court fees already paid are refunded.

Permanent Lok Adalats decide disputes with public utilities (electricity, water, transport, telecom, insurance, banking in some states) on merits up to ₹1 crore, even without agreement. The Nyaya Bandhu and Tele-Law services provide remote advice through Common Service Centres. Victim compensation for crime victims is also administered through the state authority.

What to check

Your category under Section 12, or your annual income with documents The nearest Taluk Legal Services Committee (Adoor, Thiruvalla, Ranni, Kozhencherry and Pathanamthitta courts all have them) Whether your matter is one a Lok Adalat can settle (debt, accident, family, cheque, utility) Whether you need a lawyer or only advice and drafting For crime victims: the Kerala Victim Compensation Scheme through the DLSA

What people often miss

Assuming free means poor quality. Panel lawyers are practising advocates; some are excellent. You can ask for a change if representation is deficient. Also: missing the Lok Adalat notice for a bank loan; it is the cheapest settlement you will ever be offered.

The Kerala / NRI angle

Kerala's legal services network is among the most active in the country, with para-legal volunteers in panchayats and legal aid clinics in many blocks. NRI families: the Authority cannot act abroad, but can help with matters in Kerala courts on the family's behalf. Bank loan recovery cases are routinely brought to Lok Adalats in Kerala with waivers of penal interest and part of the interest; if you have an NPA, ask the bank whether it will list it.

An example

Motor accident claim: panel lawyer, court fee of the claim borne by the Authority, compensation awarded entirely to the claimant. Bank loan of ₹6 lakh in default with ₹1.4 lakh of accrued interest and charges: at a Lok Adalat, a settlement at ₹6.2 lakh payable over six months is a typical outcome, and the award closes the case without appeal.

When this may not be the right answer

If you do not fall in a category and your income exceeds the ceiling, you pay for a lawyer. Aid can be withdrawn for false declarations or non-cooperation. Lok Adalat awards are by consent; you should not sign a settlement you cannot pay, because it is enforceable immediately.

What to do next

Visit the DLSA at the district court or the TLSC at the taluk court with ID and income or category proof Ask whether the matter suits the next Lok Adalat For quick advice, call the NALSA helpline 15100 or use Tele-Law at an Akshaya/CSC centre
