A family in Pathanamthitta pays ₹42 lakh for a flat promised in 2022 and still not delivered in 2026. The builder offers 'a few more months'. A consumer complaint at the District Commission, filed online with the agreement and payment receipts, seeks refund with interest or possession with compensation. These cases are decided regularly in Kerala and interest of 9% or more on the money is common.
The Consumer Protection Act, 2019 replaced the 1986 Act. Jurisdiction is by the value of consideration paid, not the amount claimed, under the 2021 Jurisdiction Rules (District up to ₹50 lakh; State ₹50 lakh to ₹2 crore; National above ₹2 crore). You may file where you live or work, not only where the company is. E-Daakhil allows filing, fee payment, notices and video hearings online; Kerala's commissions are on it.
Fees: nil up to ₹5 lakh; ₹200 up to ₹10 lakh; ₹400 up to ₹20 lakh; ₹1,000 up to ₹50 lakh at the district level, with higher slabs above (verify the current schedule). Limitation: two years from the cause of action, with condonation for reasons. The Act covers medical services, housing, banking, insurance, telecom, e-commerce and product liability; it excludes free services and contracts of personal service.
Commissions aim to decide within three to five months, though Kerala's dockets mean longer in practice. Appeals go up one level within 30 days (45 for the National Commission), and a respondent must deposit part of the award to appeal. Orders are enforceable like a court decree, with penalties and imprisonment for non-compliance.

Filing in the State Commission because the claim for compensation is large. It is the price paid that decides. Also: missing the two years while negotiating.
Kerala's District Commissions sit in every district, including Pathanamthitta, and accept Malayalam pleadings. Kerala's State Commission has a strong record on builder and insurer cases. Legal aid lawyers through KeLSA (Legal 2) can appear for eligible complainants if you would rather not argue yourself.
Flat ₹42 lakh: District Commission, fee ₹1,000. Insurance claim ₹3.5 lakh wrongly rejected: District Commission, fee nil. Defective ₹65 lakh car: State Commission, because the price paid exceeds ₹50 lakh.
Purely commercial purchases (goods bought for resale or large-scale commercial use) are outside, though a self-employed person's livelihood purchase is inside. Employment disputes, rent disputes and criminal matters belong elsewhere. A complaint against a government department for a statutory function (like a licence) is not a consumer matter; RTI and the ombudsman routes apply.
